workshop terms and conditions

VERY IMPORTANT : By booking a Workshop, you agree to be bound by these terms and conditions.

Definitions:

  • "Scheme" - an educational driver training programme offered as an alternative offer to prosecution.
  • "Workshop" - the workshop or forum where the Scheme is given to you.
  • "e-learning modules" - a suite of online modules, provided by a2om Limited, that must be completed within 28 days of the date you complete your Workshop.
  • "Booking Period" - 14 days from the date of the offer letter from DriveTech (UK) plc.
  • "Completion Period" - 140 days from the date of your alleged offence.

a) Booking: You must book and pay for your Workshop within the Booking Period by either booking online or telephoning DriveTech (UK) plc's Police Customer Care team. Before booking your place, you will be asked to complete an online pre-Workshop questionnaire which you will be able to access via a computer with access to the Internet. Instructions on how to access this questionnaire are detailed in your first letter from DriveTech (UK) plc – the ‘offer’ letter. You should complete the online questionnaire within the Booking Period otherwise you will be unable to book automatically a place on a Workshop and your file may be returned to the police and the offer of the Scheme may be withdrawn. If you lose your login details, you may call the DriveTech Police Customer Care team on 0845 345 9625 to confirm them. For technical support on completing the online survey, please call the a2om helpline on 0845 508 1822. When booking online, you can select your preferred date and time. When booking by telephone, you will be offered a limited selection of dates and times and you will be expected to select one.

b) Failure to book: Failure to book and secure your place within the Booking Period will result in your file being returned to the police and the offer of the Scheme will be withdrawn.

c) Payment: Payment can be made by most credit and debit cards, by cheque or by postal order. We are unable to accept post-dated cheques or cash. Cheque or postal order payments for a Workshop must be made payable to DriveTech (UK) plc and received by DriveTech (UK) plc within 7 days of the date of booking to secure your place. Once you have booked your Workshop, it is non-transferable and non-refundable.

d) Cheques: Any cheque returned to DriveTech (UK) plc without sufficient funds in your account will result in an administration charge of £8.00. In this event, we may cancel your booking, but you may be able to reschedule your Workshop (also see Clause k). Any subsequent payments must be made by credit/debit card. If you are unable to satisfy this requirement, your file will be returned to the police and the offer of the Scheme withdrawn.

e) Completion date: Your Workshop and e-learning modules must be completed within the Completion Period. If you are unable to complete within this time, your file will be returned to the police and the offer of the Scheme will be withdrawn.

f) Workshop completion: You must satisfactorily complete the Workshop by attending in person, arriving on time, be present for the entire duration and participating fully (which shall be determined at the sole discretion of the trainer). Mobile phones and/or pagers must be switched off during the Workshop.

g) E-learning module completion: To meet the legal requirements for Scheme completion, you must satisfactorily complete a series of e-learning modules within 28 days of completing the Workshop otherwise your file will be returned to the police and the offer of the Scheme will be withdrawn. Instructions on how to access these modules are detailed in your second letter from DriveTech (UK) plc – the ‘Joining Pack’. If you lose your login details, you may call the DriveTech Police Customer Care team on 0845 345 9625 to confirm them. For technical support on completing the e-learning modules, please call the a2om helpline on 0845 508 1822.

h) Use of information: Where applicable as part of the Workshop, you will be asked to supply information that will be used to provide you with an individual, unique and personal driver risk profile and to complete both pre- and post-workshop questionnaires for research purposes. No information will be collected that can identify any individual person. The anonymous information you proivde may be used for research purposes to help identify benefits of the scheme and develop potential future training programmes. After completing the e-learning modules, you will be asked to provide your email address to a2om so they can contact you about follow-up research only.

i) Non-attendance: If you are unable to attend your Workshop:
  1) Due to exceptional circumstances: i.e. bereavement, medical grounds or you are a parent or carer and your dependant is taken ill, you will be able to reschedule your Workshop, subject to availability and payment of a rescheduling fee of £30 (also see Clause k). Documentary evidence justifying your non-attendance will be required.
  2) For any other reason: you will be able to book another Workshop, subject to availability and payment of the full Workshop fee again which can only be made by credit or debit card.

j) Non-completion: If you are unable to complete your Workshop:
  1) Because you arrive late: you will be refused entry, your file will be returned to the police and the offer of the Scheme will be withdrawn, unless you reschedule your Workshop. If you reschedule your Workshop, you will incur rescheduling fees (also see Clause k) unless the delay has been caused through major disruption to the local public transport or road network, e.g. a major incident resulting in tube/train or road closures. You will be expected to leave sufficient time for your journey allowing for general delays.
  2) Because you fail to establish your identity satisfactorily (also see Clause l): you will be refused entry, your file will be returned to the police and the offer of the Scheme will be withdrawn, unless you reschedule your Workshop. If you reschedule your Workshop, you will incur rescheduling fees (also see Clause k). No refund of original Workshop fees will be made.
  3) Because you are under the influence of alcohol or drugs: you will be refused entry to the Workshop, your file will be returned to the police and the offer of the Scheme will be withdrawn. You will not be able to reschedule and no refund of original Workshop fees will be made.
  4) Because you are abusive, disruptive or fail to participate fully: you will be ejected from the Workshop, your file will be returned to the police and the offer of the Scheme will be withdrawn. You will not be able to reschedule and no refund of original fees will be made.

k) Rescheduling: Rescheduling your Workshop, for any reason whatsoever, is your responsibility, subject to availability and the rescheduled Workshop must be completed within the Completion Period. Rescheduling is also subject to the following fees: if you reschedule more than 28 days before the date of your Workshop, there is no rescheduling fee; between 14 and 28 days before, there is a rescheduling fee of £30; less than 14 days before, you will have to pay the full Workshop fee again. Payment of rescheduling fess can only be made by credit or debit card.

l) Personal identification: When you attend your Workshop, you must produce suitable photographic identification (e.g. driving licence or passport). If you do not have photographic ID, you must bring two separate forms of identification; for example, an original utility bill (gas, electricity or home phone ) or council tax bill or a bank or credit card statement that we can match with your details given to us by the police.

m) Workshop cancellation: In the event of DriveTech (UK) plc being unable to deliver your Workshop for any reason outside of our control, we will reschedule your Workshop as soon as possible and in any case within the Completion Period and it will be free of any additional charge.

n) Special needs: You must notify DriveTech (UK) plc of any special needs, for example disability and/or access issues, that you wish to be taken into consideration for the provision of the Workshop or e-learning modules so that suitable arrangements can be made or advice given.

o) Warranties: To the maximum extent permitted by law, DriveTech (UK) plc gives no warranties and makes no representations of any kind relating to the Workshop including, without limitation, any implied warranties of fitness for a particular purpose, or merchantability.

p) Liability: To the maximum extent permitted by law:
  1) DriveTech (UK) plc will not in any circumstances (including, without limitation, negligence or breach of statutory duty) be liable for any loss of income, loss of opportunity or entitlement, loss of revenue or savings, or for any consequential damages (whether arising from any Workshop, from your attendance at, or inability to attend, any Workshop, or otherwise); and
  2)the liability of DriveTech (UK) plc to you arising out of any and all claims (whether arising from any Workshop, from your attandance at, or inability to attend, any Workshop, or otherwise) will not in any circumstances exceed in aggregate the total amount of the sums paid to you by DriveTech (UK) plc for the Workshop to which that liability relates.

Additional terms and conditions only if you were issued with an endorsable fixed penalty notice by a police officer 

q) Driving licence: Where you have surrendered your driving licence, it will be held by Thames Valley Police for the period from surrender to successful completion of the Young Driver Workshop or your request for a court appearance or payment of fixed penalty fine when it will be automatically returned to you by post to the address provided on the offer acceptance form. If you change address in the meantime or have any queries on your licence return, please call Thames Valley Fixed Penalty Support Unit on 01865 293356.

The receipt you received from the police office is proof that you have a licence but if you require your licence to be returned to you for any reason whatsoever;

  1) please write to YDS Licence Return, Fixed Penalty Support Unit, Thames Valley Police, PO Box 156, Warwick Road, Banbury, Oxon OX16 7UX stating your name, address and that you require your licence to be returned to you. You must also complete and enclose either part 2 or 3 of the original fixed penalty notice. If you have paid a booking fee to DriveTech to attend the Young Driver Workshop, no refund of original Workshop fees will be made.
  2) if you enclose part 2, you must provide payment for the fixed penalty with your request. Please be aware that by doing so your licence will be endorsed with the appropriate number of penalty points before return.
  3) if you enclose part 3, your licence will be returned unendorsed and a summons will be raised for you to attend court on a date and time to be arranged. If you do not provide payment or request a court hearing, the fixed penalty fine will be increased by 50% and registered at your local court. Please see the reverse of the fixed penalty notice for information.
